By accessing or using the Apexis website and mobile application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the Service.

Apexis is a fitness tracking platform designed to help users log workouts, track progress, and achieve their fitness goals. The Service is provided "as is," and we reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice.

3. User Accounts

To use certain features of the App, you must create an account. You represent that the information you provide is accurate. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

We reserve the right to disable any account if we believe you have violated these terms.

By logging workouts or uploading data to the Service, you grant Apexis a non-exclusive, royalty-free, worldwide license to host and use that content solely for the purpose of providing and improving the Service to you. We do not claim ownership of your data.

7. Limitation of Liability

Apexis and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use the Service. We do not guarantee the accuracy of any fitness data or metrics provided within the App.

8. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Apexis operates, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes via in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the new Terms.
